TEXT MESSAGING PROGRAM TERMS & CONDITIONS

A Different Thread (“we,” “us,” or “our”) offers fans and subscribers recurring and occasional text messaging programs. These Terms and Conditions govern all A Different Thread text message communications.

ARBITRATION AND CLASS ACTION WAIVER NOTICE

THESE TERMS AND CONDITIONS INCLUDE AN ARBITRATION CLAUSE/CLASS-ACTION WAIVER/DISPUTE RESOLUTION PROVISION BELOW THAT AFFECTS YOUR RIGHTS. PLEASE READ THEM CAREFULLY. EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THAT PROVISION, YOU AND A DIFFERENT THREAD AGREE THAT DISPUTES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION. THAT MEANS AN ARBITRATOR, NOT A JUDGE OR JURY, WILL DECIDE ANY DISPUTE. YOU ALSO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.

Program Description and Consent

You may sign up for our text messaging program by entering your phone number on our website, newsletter forms, tour pages, or other opt-in forms, or by otherwise providing your consent.

By opting in, you agree to receive recurring or occasional SMS or MMS messages from A Different Thread. These messages may include:

  • Tour dates and show announcements

  • New music releases

  • Presale or ticket information

  • Merchandise drops

  • Exclusive content or updates

  • Occasional promotional or marketing messages

Messages may be sent using automated technology.

Consent to receive messages is not required to make any purchase.
Message and data rates may apply.
Message frequency will not exceed 5 messages per month

Message Frequency

We aim to send occasional updates only. You will generally receive no more than 5 messages per month, usually less, though you may occasionally receive slightly more, depending on tour schedules, releases, or announcements.

Opt-Out Instructions

You may stop receiving text messages at any time by replying:

STOP

to any message from us.

You will receive one final message confirming your unsubscribe request. After that, you will no longer receive text messages unless you opt back in.

Eligibility and User Responsibility

By signing up, you represent that:

  • You are the authorized user of the mobile number provided

  • You consent to receive messages at that number

  • You are responsible for notifying us if your number changes

Not all mobile carriers may support this service. Delivery is not guaranteed.

Carriers are not liable for delayed or undelivered messages.

Changes to Messaging Program

We reserve the right to modify or discontinue our text messaging program at any time, including changing the frequency or types of messages. We may notify you of material changes via text or by updating these Terms on our website.

Your continued participation after changes constitutes acceptance of those changes.

ARBITRATION / DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your participation in our messaging program (“Dispute”) will first be addressed informally by contacting us at hello@adifferentthread.com.

If the Dispute cannot be resolved informally, it shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration will take place on an individual basis only.

You waive any right to:

  • Jury trial

  • Class action

  • Collective or representative proceeding

Claims eligible for small claims court may be brought there instead.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Our text messaging services are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, A Different Thread makes no warranties, express or implied, regarding:

  • Delivery reliability

  • Accuracy or completeness of messages

  • Uninterrupted or error-free service

We are not liable for any indirect, incidental, special, or consequential damages arising from your participation in the program or inability to receive messages.

Indemnification

You agree to indemnify and hold harmless A Different Thread from any claims arising from:

  • Providing a phone number you do not own or control

  • Failing to update your contact information

  • Your violation of these Terms or applicable laws

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Changes to These Terms

We may update these Terms at any time. Updated versions will be posted on our website. Continued participation in the messaging program constitutes acceptance of the revised Terms.
